Showtime suing Top Rank over Mayweather - Pacquiao fight

Showtime is coming out swinging — in the legal arena.

Showtime Networks Inc. is suing boxing promoter Top Rank Inc. over the championship bout between Manny Pacquiao and Floyd Mayweather on May 2, 2015 in Las Vegas.

In the suit, filed in federal court in New York on Wednesday, Showtime claims that Top Rank was contractually obligated “to defend and indemnify” Showtime.

After the fight, which resulted in a unanimous decision for Mayweather, it was revealed that Pacquiao had injured his shoulder prior to the fight, an injury that was previously undisclosed.

Showtime’s complaint says that the fight resulted in numerous class-action lawsuits, some of which Showtime was named in. Showtime claims that it has been in the process of obtaining dismissal of the actions, paying for its own legal fees, despite Top Rank’s alleged obligation to indemnify and defend them.

Alleging breach of contract and other counts, Showtime is asking for a declaration that Top Rank was obligated to indemnify Showtime.
